Agreement and scope

These Terms of Use (“Terms”) govern your access to Eva AI, Inc.'s public website and public AI Before & After preview experience. By using those services, you agree to these Terms. If you do not agree, do not use them. A practice's paid or staff use of Eva is governed by its signed order form, services agreement, and data-processing terms, not these public Terms.

Eligibility

You must be legally able to enter this agreement. The public preview is offered only to adults age 18 or older who are in the United States and use a photo of themselves. You may not use the preview for another person, a minor, or someone who has not authorized you to provide their information.

The preview is an illustration

An AI preview is a simulated illustration based on the submitted photo and selected options. It is not a diagnosis, medical advice, a clinical prediction, or a guarantee of an outcome. Generated images may be inaccurate, incomplete, or unrealistic. Individual results vary. Do not use a preview to make a treatment decision or delay professional care.

Licensed providers make clinical decisions

Eva may summarize your stated goals or estimate nonclinical consultation readiness from your choices, timing, and engagement. That information does not establish medical eligibility or clinical suitability and must not be used to deny care or determine treatment pricing. Only a qualified, licensed provider can assess your health, discuss risks and alternatives, and decide whether a treatment is appropriate.

Your submissions and permissions

You retain your rights in content you submit. You represent that your information is accurate to the best of your knowledge, that an uploaded photo depicts you, and that you have the necessary rights to submit it. You grant Eva and, on a practice-branded page, the named practice only the permissions you affirm in the preview to process, store, and share your content for the disclosed preview and consultation purposes. Under the current permission, Eva will not use customer photos, previews, or related customer data to train or fine-tune AI models. The Photo & AI Notice explains these permissions, retention, and deletion choices.

Acceptable use

You may not use Eva to violate law or another person's rights; submit deceptive, unlawful, infringing, or malicious material; probe or bypass security, rate limits, consent controls, or access restrictions; introduce malware; scrape or overload the services; impersonate another person; or use outputs to misrepresent an actual clinical result. We may restrict or end access when reasonably necessary to protect people, Eva, customers, or the services.

Eva materials

Eva and its licensors own the website, software, branding, interfaces, and other service materials, excluding your submissions. Subject to these Terms, Eva gives you a limited, revocable, nonexclusive, nontransferable right to use the public services for personal, noncommercial purposes. No other license is granted.

Third-party services and practices

Eva may rely on or link to third-party providers, integrations, websites, or participating practices. Their services and clinical or business decisions are controlled by them. Eva is not a healthcare provider and does not provide or control a practice's medical services, pricing, availability, informed-consent process, or treatment outcome.

Service changes and availability

We may improve, change, suspend, or discontinue features and may impose reasonable usage, security, or geographic limits. We do not promise uninterrupted or error-free availability. Preview generation may fail, be delayed, or be unavailable because of image quality, capacity, safety controls, or third-party systems.

Disclaimers

To the maximum extent permitted by law, the public services are provided “as is” and “as available.” Eva disclaims implied warranties of merchantability, fitness for a particular purpose, noninfringement, and any warranty arising from course of dealing or usage. Nothing in these Terms excludes a warranty or consumer right that cannot lawfully be excluded.

Limitation of liability

To the maximum extent permitted by law, Eva and its officers, employees, affiliates, and providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, goodwill, or opportunities, arising from the public services. Eva's total liability arising from your use of a free public service will not exceed one hundred U.S. dollars. These limits do not apply where prohibited by law or to liability that cannot lawfully be limited.

Privacy, changes, and contact

Our Privacy Policy and Photo & AI Notice explain our data practices. We may update these Terms by posting a revised version with a new effective date and providing additional notice when required. Continued use after an update takes effect means you accept the revised Terms. If a provision is unenforceable, the remaining provisions continue in effect.
